Art. 1 – Scope of application
The present general conditions apply to all transactions concluded through the site https://www.anthony-c.com/.
Is considered as a customer, any person or entity making an order through the site https://www.anthony-c.com/.
Art. 2 – Products and services
On the site www.anthony-c.com, any user can order reproductions of illustrations. These reproductions are published in limited quantities, numbered and signed. If the quantity of a model is exhausted, no new edition will be proposed. This model in its current state will no longer be available for sale via the website https://www.anthony-c.com/.
Any user can order an original illustration whether it is already made and available, or simply personalized. Every illustration made by the artist Anthony-C is original and unique, identified, dated and signed. To know which original illustrations are available or to order a personalized illustration, any user must fill in the contact form available at this address: https://www.anthony-c.com/fr-contact/.
Art. 3 – Order
Any order placed by the site https://www.anthony-c.com/ implies the full acceptance and without reserve of the present general conditions of sale. These terms and conditions may be subject to change, in which case, the applicable conditions will be those in effect at the date of the order. A confirmation email will then be sent to the customer, specifying that the registration and status of the order. The order is then prepared within 24 to 48 hours. Exceptions may be encountered, any additional time will be notified to the customer in the confirmation email. Once the order has been shipped, the customer will receive an invoice by email and a tracking number for the order.
Art. 4 – Prices
The prices are indicated in euros €. The amounts are indicated without taxes, VAT not applicable, art. 293B of the CGI.
For any illustration(s) made on request, an estimate will be presented by email to the client. Once the estimate is validated by the client and the artist, the client cannot claim any modification of the illustration. For shipping costs, see the heading SHIPPING COSTS, below.
Art. 5 – Payment
The orders placed on the site https://www.anthony-c.com/ are shipped only after the payment is validated. It is possible to pay by credit card via the payment module Stripe proposed during the finalization of the order.
For illustrations immediately available for sale, payment is due on the date of the order. For illustrations made to order, a deposit of 30% of the total price will be required. The payment of this deposit is essential before any beginning of an illustration ordered by the customer. Work on the illustration will not begin until the deposit is received. This deposit will be deducted from the final amount of the order. In the event of cancellation of the order by the client, the deposit already paid will be retained by the contractor as compensation for the work undertaken, regardless of the progress of the project. In case of cancellation of the order by the artist, the deposit already paid will be returned in its entirety within thirty days by check to the client. Unless an additional payment period is clearly granted, the payment of the invoice is due on the date of receipt of the invoice or at the latest 30 days after its issue. Any delay in payment shall automatically give rise, without the need for any formal notice, to the payment of late payment penalties amounting to three (3) times the ECB rate plus ten (10) points (LME Act No. 2008-776), and to the payment of a flat-rate indemnity for collection costs in the amount of €40 (Article L441-6 of the Commercial Code). All payments are made in euros by bank transfer, by PAYPAL (subject to certain conditions). The ordered illustration is sent within two working days once the total payment has been received. Cash payment is only possible in person.
Art. 6 – Deduction
This section concerns only professional sponsors.
The status of independent artist affiliated to the Maison Des Artistes requires the professional sponsor to pay the charges directly to the Maison Des Artistes. This amount is clearly indicated on the invoice. The original of the certification must be returned to Anthony CAILLON with the payment of the invoice. The rates are expressed in euros and without taxes. VAT is not applicable, in accordance with article 293B of the CGI.
The invoice issued to the professional client includes :
- The gross amount listed in the estimate
- The mandatory deductions to be made from the gross amount
In the end, the amount of the estimate does not change and two checks are to be issued: a first check addressed to Anthony CAILLON and a second check addressed to the Maison Des Artistes.
The private individuals are not concerned by the payment of the charges to the House of the Artists.
Art. 7 – Delivery
All orders are shipped within 24 to 48 hours after validation of full payment.
Exceptions can however be encountered. The customer will then be notified by email as soon as possible.
Once the order is shipped, the tracking number of the order will be sent by email to the customer.
Art. 8 – Shipping costs
When ordering on the site https://www.anthony-c.com/, the shipping costs are indicated during the validation of the order.
These shipping costs include shipping and transportation of the order as well as insurance in case of damage or loss.
Orders are insured up to their value.
In case of damage or loss upon receipt of an order. The customer must report the problem within 48 hours to the sender, Anthony-C. Photos will then be requested in order to provide proof of the existence of damage or loss during the carrier’s service. An investigation by the carrier will then be initiated to determine the person or persons responsible for the damage. Upon resolution of this investigation, and only if it concludes that the customer is not at fault, the shipping of an identical order or a refund will be offered to the customer.
When ordering a personalized illustration, the shipping costs are taken care of and follow the same conditions.
Art. 9 – Delivery time
All orders are shipped within 24 to 48 hours after validation of the total payment.
Exceptions can however be encountered. The customer will then be notified by email as soon as possible.
In no case the delay can be a source of retraction of the customer without the agreement of the artist Anthony-C.
Art. 10 – After-sales service
No after-sales service can be claimed.
Art. 11 – Right of withdrawal
The right of withdrawal applies only to natural persons and to works immediately available for sale. In accordance with Articles L. 120-20 of the Consumer Code, the consumer has a period of seven calendar days to return the order that does not suit him. This period runs from the day of receipt by the customer of the work ordered. Any return will have to be announced as a preliminary with the artist Anthony-C.
In the event of the exercise of the right of withdrawal, the customer has the choice of requesting either a refund of the sums paid, or to order a new work involving a delay of creation. In the case of a new order, the reshipment will be at the expense of the customer.
In the event of exercising the right of withdrawal and wishing to be reimbursed for the sums paid, the artist Anthony-C will do everything in his power to reimburse the client within thirty calendar days of receiving the return of the work in question.
Only orders returned in their entirety in perfect condition for resale will be accepted. Any illustration or reproduction that has been damaged will not be refunded, taken back or exchanged. This right of withdrawal is exercised without penalty, with the exception of shipping and return costs.
For works on demand, the customer has no withdrawal period in accordance with Article L121-20-2 of the Consumer Code.
Art. 12 – Intellectual property
This site, the works presented on it, as well as the works sold are and remain the property of Anthony-C. Any reproduction, complete or partial, is systematically subjected to the authorization of the artist Anthony-C.
Art. 13 – Force majeure
The artist Anthony-C cannot be held responsible if the non-execution or the delay in the execution of one of the obligations described in the present general conditions of sale results from a case of force majeure. In this respect, force majeure is defined as any external, unforeseeable and irresistible event within the meaning of Article 1148 of the Civil Code.
Art. 14 – Litigation
Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law. In the absence of an amicable resolution, the dispute shall be brought before the Commercial Court of Orleans, 44 rue de la Bretonnerie BP 92015 45000 ORLEANS, FRANCE.
